that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability.

Owner agrees to notify Trainer of any and all change of addresses, emergency telephone numbers, itineraries or other information reasonably necessary to contact Owner in the event of an emergency. In the event Owner departs for vacation or is otherwise unavailable, prior to departure Owner shall notify Trainer as to what party is authorized to make decisions in the Owner's place with regard to the health, well-being, and/or medical treatment of the horse(s).

However, Trainer will not be obligated to retain and/or maintain the horse(s) in question in the event the amount of the bill exceeds the

In the event Trainer exercises Trainer's lien rights as above-described for non-payment, this Agreement shall constitute a Bill of Sale and authorization to process transfer applications from any breed registration as may be applicable to said horse(s) upon affidavit by Trainer's representatives setting forth the material facts of the default and foreclosure as well as Trainer's compliance with foreclosure procedures as required by law. In the event collection of this account is turned over to an attorney, Owner agrees to pay all attorney's fees, costs, and other related expenses for which a minimum charge of $250.00 will be assessed.

Get Answers on Horse Training Contract

What is the purpose of the Horse Training Contract?

The Horse Training Contract serves as a formal agreement between the Trainer and the Owner regarding the training and care of the Owner's horse. It outlines the responsibilities of both parties, including payment terms, training expectations, and liability issues. This contract ensures that both the Trainer and Owner have a clear understanding of their obligations and rights throughout the training period.

What are the payment terms for training services?

Owners are required to pay a monthly fee for training and board, which is specified in the contract. Payments are due on the 1st of each month, and the initial payment will be prorated to the start of the next month upon the horse's arrival. If payment is overdue by five days, training will stop, and a late fee of $10 per day will be added. The Trainer has the right to retain possession of the horse until all fees are paid in full.

What happens if my horse requires veterinary care?

The Trainer will use a veterinarian of their choice for ordinary care unless the Owner specifies otherwise. If the Owner's veterinarian is unavailable, the Trainer may proceed with their own choice. All veterinary expenses are the Owner's responsibility. If the horse requires emergency treatment and the Trainer cannot reach the Owner, the Trainer is authorized to secure necessary care, with costs billed to the Owner.

What is the Trainer's liability regarding the horse's health and safety?

While the Trainer is responsible for the care of the horse, they are not liable for any illness, injury, or death that occurs unless it results from negligence on their part. The Owner assumes all risks associated with the horse's care and agrees to obtain insurance for any horse valued over $5,000. The contract limits the Trainer's liability to $5,000 per horse.

Can the contract be terminated early?

Yes, either party may terminate the contract with thirty days' written notice. However, if the Owner wishes to remove the horse before the agreed training period is complete, an early termination fee may apply. All fees for the horse's stay must be paid prior to its departure.

What are the Owner's responsibilities regarding the horse's health?

The Owner must ensure that the horse is up-to-date on vaccinations, worming, and hoof care. If the Owner fails to provide proof of these services within thirty days, the Trainer may arrange for the necessary care at the Owner's expense. It is crucial for the Owner to disclose any known behavioral issues or health concerns about the horse.

What should I do if I want to visit my horse during training?

Owners are encouraged to visit their horses regularly. However, visits should be scheduled in advance to ensure the Trainer can accommodate them without interrupting training sessions. If an Owner arrives unannounced after the horse has already completed its training for the day, another session will not be provided. Setting up an appointment will guarantee a more personalized visit.

Common mistakes

When filling out the Horse Training Contract form, individuals often make several common mistakes. One major error is failing to provide complete information in the designated fields. For example, leaving the horse's name blank or not specifying the training purpose can lead to confusion later. This information is essential for both the Trainer and the Owner to ensure that expectations are aligned.

Another frequent mistake involves overlooking the payment details. Owners might forget to fill in the monthly fee or the duration of the training period. This omission can cause misunderstandings regarding financial obligations. Ensuring that these sections are completed accurately is crucial to avoid any disputes over payments.

Additionally, many people neglect to read the entire contract before signing. Important clauses regarding liability and emergency care can be missed, which may lead to unexpected consequences. Understanding these terms helps Owners know their rights and responsibilities, as well as the Trainer's obligations.

Some Owners also fail to disclose any hazardous behaviors of their horses. This oversight can pose risks not only to the Trainer but also to other horses and individuals on the property. Being transparent about any known issues is vital for safety and proper training.

Moreover, individuals often forget to provide up-to-date contact information. In emergencies, the Trainer must be able to reach the Owner quickly. If the Owner goes on vacation or changes their phone number, this information should be communicated to the Trainer to ensure the horse receives the necessary care.

Lastly, many people do not take the time to initial or sign where required, especially in sections concerning media consent or acknowledgment of rules. These small details can lead to significant issues down the line. Every signature and initial serves to confirm understanding and agreement to the contract's terms.

  • Insurance Policy: An equine insurance policy provides coverage for health issues or accidents involving a horse. It shares similarities with the risk management clauses in a training contract.
  • Liability Waiver: A liability waiver releases one party from responsibility for certain risks. This is comparable to the risk assumption and hold harmless provisions in a horse training contract.

Dos and Don'ts

When filling out the Horse Training Contract form, it is important to be thorough and accurate. Below is a list of things you should and shouldn't do during this process.

  • Do read the entire contract carefully before signing to ensure you understand all terms and conditions.
  • Do provide accurate information about yourself and your horse, including any health issues or behavioral concerns.
  • Do ask questions if any part of the contract is unclear; communication with the trainer is essential.
  • Do keep a copy of the signed contract for your records after it has been completed.
  • Don't leave any sections blank; incomplete forms can lead to misunderstandings later on.
  • Don't rush through the process; take your time to ensure all information is correct and complete.

Misconceptions

1. Misconception: The Trainer Guarantees Results

Many people believe that signing a Horse Training Contract guarantees specific outcomes for their horse. This is not the case. The Trainer does not guarantee results because training effectiveness varies based on each horse's individual abilities.

2. Misconception: The Trainer is Responsible for All Veterinary Care

Some owners think that the Trainer will handle all veterinary needs without any input. While the Trainer will use their preferred veterinarian, the Owner is ultimately responsible for all veterinary expenses, including routine care and emergencies.

3. Misconception: The Owner Can Remove the Horse at Any Time

Many owners assume they can take their horse home whenever they want. However, the contract requires a 30-day notice for termination of services, along with any outstanding fees before departure.

4. Misconception: The Trainer is Liable for All Damages

Some believe that the Trainer is liable for any injury or loss that occurs while the horse is in their care. The contract clearly states that the Trainer is only liable for negligence, limiting their responsibility significantly.

5. Misconception: The Trainer Provides Insurance for the Horse

It is a common misunderstanding that the Trainer carries insurance for the horses they train. In fact, the contract specifies that the Owner must obtain their own insurance for any horse valued over $5,000.

6. Misconception: The Trainer Will Always Notify the Owner of Emergencies

Some owners think the Trainer will always contact them in case of an emergency. While the Trainer will attempt to reach the Owner, they are authorized to seek emergency care if contact cannot be made.

7. Misconception: All Training Fees Are Fixed

Many assume that the training fees are set in stone. However, the contract allows for additional fees, such as late payment charges and costs for extra services like individual lessons.

8. Misconception: The Owner Has No Responsibilities

Some owners mistakenly believe that their role is minimal once the horse is in training. The contract outlines several responsibilities for the Owner, including providing necessary information, paying for services, and ensuring the horse's health and safety.

Key takeaways

When filling out and using the Horse Training Contract form, keep these key points in mind:

  • Understand the Fees: Be clear about the monthly or daily fees for training and board. Payments are due on the 1st of each month.
  • Payment Responsibilities: Ensure all expenses are paid in full before your horse is released. Late payments incur additional fees.
  • Veterinary Care: The Trainer will choose the veterinarian unless you specify otherwise. You are responsible for all related costs.
  • Training Expectations: Know that the Trainer cannot guarantee specific results, as outcomes depend on the horse's individual abilities.
  • Emergency Procedures: Be aware that the Trainer may seek emergency care for your horse if you cannot be reached.
  • Liability Limitations: The Trainer is not liable for injuries or losses unless due to negligence. Consider obtaining equine insurance for added protection.
  • Rules and Regulations: Follow all Trainer's rules. If someone else picks up your horse, they need written permission from you.
  • Entire Agreement: This contract is the full agreement between you and the Trainer. No other verbal agreements are valid unless written in this contract.

By being aware of these points, you can ensure a smoother experience when working with the Trainer and caring for your horse.
