The Independent Associate Agreement form is a document that individuals fill out to apply to become an Independent Associate of TVC Marketing Associates, Inc. By signing this form, applicants agree to the terms and conditions laid out by the company, which governs their relationship as independent contractors rather than employees.
What are the eligibility requirements to become an Associate?
To become an Associate, you must be of legal age to enter into contracts in your state and in Oklahoma, where the agreement is accepted. It’s essential to note that if you are married, the company considers both spouses as a single Associate, meaning they cannot sponsor each other directly or indirectly.
What does it mean to be an Independent contractor?
As an Independent contractor, you are running your own business under the brand of TVC. This means you are responsible for your income taxes, health insurance, and business expenses. TVC does not withhold taxes from your earnings, nor do they provide a salary.
Can I cancel my Associate Agreement?
Yes, you can cancel your participation at any time. All you need to do is send written notice to TVC. However, remember that cancellation does not give you the right to claim any commissions that may have been earned prior to the cancellation.
What if my application is not accepted?
If TVC decides not to accept your application, you cannot make any claims against the company. TVC has the discretion to accept or reject applications as they see fit.
Sponsoring Associates are responsible for providing necessary training and assistance to the Associates they sponsor. It’s important for them to support their team in order to promote a successful business environment.
Are there restrictions on advertising TVC products and services?
Yes, you must get prior written approval from TVC before advertising their products or services. This ensures that all advertising is consistent with TVC’s branding and policies.
Can I transfer my Associate Agreement to someone else?
Transferring your Associate Agreement requires written consent from TVC, which they are not obligated to provide. If you want to transfer earned commissions, TVC has the right of first refusal to purchase your commissions at fair market value.
What are the consequences of soliciting TVC's competitors?
During the duration of your Agreement, you agree not to solicit business for any competitor of TVC. Furthermore, for one year after your Agreement ends, you cannot solicit TVC members or attempt to cancel their memberships.
What happens if the agreement becomes unenforceable?
If any part of the agreement is deemed illegal or unenforceable, the remaining provisions will still be valid. This allows the agreement to remain intact even if one section encounters legal issues.
